This Privacy Policy explains how TMS Near Me ("we," "us," or "our") collects, uses, and shares information when you visit tmsnearme.com (the "Site") or use any of the services offered through the Site.

This Site is operated by Adrian Sinclair, a sole proprietor doing business as TMS Near Me, located at 7620 NE Roswell Road, Atlanta, GA 30328. If you have questions about this policy, contact us at info@tmsnearme.com.

This Site is intended for users who are at least 18 years of age. By using the Site, you confirm that you are 18 or older. We do not knowingly collect personal information from anyone under 18. If you believe a minor has submitted personal information to us, contact info@tmsnearme.com and we will delete it.

This Site is intended for users located in the United States. We do not knowingly direct our services to users in the European Union, United Kingdom, or other regions with comprehensive data protection laws beyond U.S. federal and state requirements.

    1. What This Site Does

TMS Near Me is a directory of clinics in the United States that provide transcranial magnetic stimulation (TMS) therapy and related mental health treatments. We allow visitors to search for clinics, view clinic profiles, and request appointments. We also allow clinic owners to claim and manage their listings and to purchase featured placement.

We are not a healthcare provider. We do not provide medical advice, diagnose conditions, or deliver treatment. Listings on our Site are not endorsements. Always consult a licensed medical professional regarding your health.

    2. Information We Collect

We collect the following categories of information.

Information you provide when you submit an appointment request. This includes your name, email address, phone number, and any additional details you choose to share (such as insurance information, symptoms, or messages to the clinic). When you submit an appointment request, this information is sent to the clinic you selected and is stored in our database.

Information you provide when you submit a clinic listing. If you are a clinic owner or representative submitting your clinic to our directory, we collect your name, email address, clinic name, clinic address, clinic phone number, clinic website, and any other details you provide about the clinic.

Information you provide when you create an account. If you create a clinic owner account to manage a listing, we collect your email address and password. Passwords are stored in encrypted form by our authentication provider; we do not have access to your plain-text password.

Payment information. If you purchase featured placement or another paid service, payment is processed by Stripe, Inc. Stripe collects your payment card details directly. We do not store, see, or have access to your full payment card number. We receive only a confirmation that payment was successful and limited transaction metadata (such as the last four digits of your card and your billing zip code).

Information collected automatically when you visit the Site. This includes your IP address, browser type and version, device type, operating system, referring URL, pages visited, time spent on pages, and similar technical data. This information is collected through server logs and through the third-party analytics and advertising tools described in Section 4 below.

    3. How We Use Information

We use the information we collect to:

    • Operate and maintain the Site
    • Process appointment requests and forward them to the relevant clinic
    • Review and approve clinic listing submissions
    • Manage clinic owner accounts
    • Process payments for featured placement and other paid services
    • Send transactional emails (such as appointment confirmations, listing approval notifications, payment receipts)
    • Measure and improve Site performance, including which pages are most useful to visitors
    • Detect and prevent fraud, abuse, and security incidents
    • Comply with legal obligations

We do not sell your personal information. We do not rent your personal information.

    5. How We Share Information

We share information only as described here.

With clinics, when you submit an appointment request. The information you submit through an appointment request form is sent to the clinic you selected so that the clinic can contact you.

When required by law. We may disclose information if we are required to do so by a court order, subpoena, government request, or applicable law, or if we believe disclosure is necessary to protect our rights, prevent fraud, or protect the safety of others.

In connection with a business transfer. If we sell or transfer all or part of our business or assets, your information may be transferred as part of that transaction. We will notify you (for example, via email or a notice on the Site) of any such transfer that materially changes how your information is handled.

We do not share your information with third parties for their own independent marketing purposes.

    6. How Long We Keep Information

We keep your information for as long as needed to provide the services described in this policy, to comply with our legal obligations, to resolve disputes, and to enforce our agreements.

Appointment request information is retained for at least three years for record-keeping purposes. Clinic listing information is retained for as long as the listing is active and for a reasonable period afterward. Account information is retained until you delete your account.

    7. Your Rights

Depending on where you live, you may have certain rights regarding your personal information. We honor these rights for all U.S. residents, regardless of state.

Right to correct. You can ask us to correct inaccurate personal information.

Right to opt out of sale or sharing for cross-context behavioral advertising. We do not sell your personal information in the traditional sense. However, our use of advertising pixels (such as Meta Pixel and Google Ads) may be considered "sharing for cross-context behavioral advertising" under the California Consumer Privacy Act (CCPA) and similar laws. You can opt out by emailing info@tmsnearme.com with "Opt Out" in the subject line, or by using the browser-based opt-out tools listed in Section 8.

You can opt out of certain types of advertising tracking using these tools:

Many browsers also support a "Do Not Track" signal or Global Privacy Control (GPC). We honor GPC signals as an opt-out of sale and sharing for cross-context behavioral advertising.

    9. Data Security

We use commercially reasonable measures to protect your information, including encryption in transit (HTTPS), encrypted password storage through our authentication provider, and access controls limiting who can view your information.
